Littleton Kelly was sworn, who saith, that on the 25th February 1832, after a heavy fall of sleet which occasioned the falling of trees & the limbs of trees, he was induced in consequence of hearing the breaking of limbs of trees to step to the door of his house. Whilst standing in the door he saw a large pine begin to fall which stood not far distant from an out or negro house. That three of his negro slaves, the above named deceased negro Charles & Phebe and another negro woman were in the house. That he saw the tree was falling owards the house and indeavored to give warning of it to the negros, but before the words were well out of his mouth, the tree fell down, on & across the house & by its weigh crushed the house beneath it, whilst said negros were in it. He immediately ran & indeavored to releive the sufferers[?] by removing the timbers[?] of the house. By the time he got them uncovered so as to see them, the two above mentioned deceased negros were breathless. Their skuls appeared to be broken & were otherwise badly bruised, occasioned by a limb of the tree or the timbers of the house, or both. That the other negro who was in the house received some hurt, but escaped without serious injury. He says, on oath, that the said Charles & Phebe came to their deaths by the fall of the tree & house & not otherwise, that the tree fell between 11 & 12 oclock, or thereabouts. The negros were removed from the place where the accident took place to his Kitchen, to shield them from the inclemency of the weather. Littleton Kelly Wm Freeman, was sworn, & saith, that he was sitting in Mr. Littleton Kelly's house on yesterday, the 25th Feb. Inst. (1832) and heard Mr. Littleton Kelly, from the door of his house, give warning of the fall of a tree, that the words were not out of his mouth before he heard the crash, this happened between 11 & 12 oclock in the day. He got up immediately & ran, where he found that the tree was a large pine & that it had fallen on & across a negro house. That he assisted in removing the timbers so as to uncover & relieve the persons who were in it. When he got to see the bodies, he found the negros Charles & Phebe lying dead, a weight[?] hole[?] was across the breast of the man & another was on the woman together with other timbers of the house. The limb of the tree appeared to him to have struck the woman. He thinks the man's head had been dashed against the jam of the chimney & his brains knocked out. The other woman escaped without any dangerous hurt as he thinks. He is satisfied that the [?] deceased negros came to their death by no otherwise violence, than by the fall of the tree on the house.
