OFFICER'S STATEMENT . . . I talked to the defendant at scene of crime about 12 o'clock an in the night and he stated to me: That a negro man and Margret Freeman got out of the car and ran. The defendants denied knowing any thing about how homicide occurred.
FIRST WITNESS: Dr. R. M. Newsom, duly sworn, testified as follows: . . . Q. Who was the boy? A. Mr. Edward Freeman. I checked his heart but didn't give him any medicine. He seemed to be under the influences of something. I have them a prescription to give him only according to the directions. In about five minutes a car drove up, didn't make any noise. . . Q. Did they tell you why they wanted you to examine his heart? A. The said his heard was hurting him and that he was nervous and upset. About that time I heard screaming. I asked if Edward had been having any trouble. Was told that he had and that his wife was going. In a few minutes, Edward waked up He jumped out of bed and started talking about who all he was going to kill this one and that. He ran out in the yard and the others in the room with us followed him. I stayed in the room. . . They finally persuaded Edward to come back in the house. By that time, he was all over himself. They insisted that I give him something but they wouldn't get close to him. No one would dare put their hands on him and I wouldn't. I couldn't get close to him. Mr. Sims paid me for my troubles. I told them I though they needed the law more than they did a doctor and I left. I got in my car and came back to Chesterfield . . . In just a few minutes Dan Hill came back and said there was a man over there in the car dead or he looked like he was dead to him and wanted me to go back over there with him. Dr. Perry and I went back over there and the man was dead in a Taxi. Q. Did you examine the dead man? A. Yes. There was a tremendous lick on the back of the head. Q. Caused by what? A. Must have been a blunt instrument.
Fourth Witness: Mr. J. D. Simms, duly sworn, testified as follows: . . . Q. At the time Lee Freeman asked you to go and get the law, why did he tell you to go? Was there any commotion? Did you go over to the Taxi and look in? A. No. Q. Did you ask him why he wanted the law and there no disturbance? A. No. I heard the scream before I went out in the yard. Q. About how long after you hear the scream was it until Lee freeman asked you to go for the law? A. 10 or 15 minutes. We tried to get Edward to quieten down. Gt him back in the house when Lee Freeman asked me to go for the law.
Sixth Witness: Louis Smith, duly sworn, testified as follows: . . Well, when the taxi pulled in there Lee Freeman, Garland Smith and myself were standing in the yard. Mr. Simm's car was parked between Dr. Newsome's car and the house. Lee and Garland went to the taxi. I heard some words but they were so low I couldn't understand what was said. I did hear some words though. I didn't try to get too close . . . Q. Did you hear what the man driving the taxi said? A. No. I did understand him to say "I am going." Lee was on one side and Smith on the other. Q. What did they have in their hands? A. Lee had an air file in his hand and Garland had a singletree in his hand. . . What I saw was Margaret trying to get out of the car. . . Q. Didi you hear the taxi driver say anything other than he was going? A. As I walked around the car, I understood him to say, "They got me."
