Lillie Robinson after being duly sworn says: that she is the wife of Willie Robinson, that they were married in June 1929 and that they have 4 children, that they live about 9 miles south of Cheraw on Highway # 52; that about 8 o'clock Sunday night while she had gone to bed Halloway Thomas came into her room, while her husband was away from home; that Halloway Thomas got in bed with her and after being there for about thirty minutes and while they were having intercourse, Willie Robinson, her husband, came in the room and stuck Halloway Thomas in the back of the head with some sort of an instrument; that her jumped out of bed and ran in the kitchen; that Willie Robinson left the house; that she then came back into the bed room and saw Halloway Thomas on the floor dead.
Personally appearing before me, Willie Robinson, Alias Jack Robinson, who, after being duly sworn, both depose and say, . . . I left my home, about nine miles south of Cheraw on U.S. Highway No. 52, and went to Cheraw, after attending church services at Bethel Church which is near my home. I returned to my home Sunday night, I would say about nine o'clock P.M. I had taken a drink of whiskey about 3:30 or 4 o'clock Sunday afternoon, but I was not drunk or under the influences heavily of liquor. Upon arriving at home, I started in the front door and heard the bed squeaking, so I turned around and went to the window on the west side of the house, I got a plank and struck in on the sleeper of the house so I could go and stand up on it. I got up on this plank and looed in the window and saw Halloway Thomas in bed on top of my wife. I could see my wife's head and legs from where I was standing. I got down, eased around to the back door and eased it, the back door, open. I then tipped on into the room. Just inside the room door was a straight chair. I picked it up and struck Halloway Thomas across the back of his head three times. I pulled him off my wife onto the floor . . .
