A. Gas . . . Q. What was Mr. Laney doing? Was he a truck driver? A. Yes, sir . . . A. Will you tell the jury, please, just in your own words, what occurred? A. We were running as usual. He just drove up to the shove. The shovel was on an elevated curve, and whenever I swung around over the truck, dumped it, went back for another load, came over the truck. Instead of coming back the boom, instead of coming back, the threads stripped off in the bolts, the whole thing fell off sideways on the tuck. The bucket going on the truck, the body of the truck and the boom on the motor . . . Q. Where was Mr. Laney when this accident occurred? A. I couldn't say to that. He was not sitting in the seat, I know that. I don't know weather he was standing on the running board or down beside the truck. I couldn't say. . . . Q. did you help pick him up. A. Yes, sire, me and this colored boy was the first ones there, got there about the same time. Q. D. you know his name A. Billie Anthony. . . Q. Where was he? A. His feet was kinder under the running board of the truck and head laid back; his head kinder toward the shovel and he back of the truck . . . Q. Was he able to speak at that time? A. Yes, sir. Q. Do you recall the statement that he made? A. He said, "Take me out". . .
BENNY ANTHONY, being first duly sworn, testifies as follows . . . Q. Do you know where it hit him? A. Somewhere in his stomach, We never looked. Q. What did he say. A. I ran around there. I was the first on who got there. It hit me too. I asked if he was hurt. He said, "Yes," and "Take me out." We both grabbed him, carried him out . . .

Now, Mr. Bowers, where this boom works on the foot; there is supposed to be two cuffs that this boom fits right in on each side? A. Yes, sir. Q. Both of these were broken at that time? A. Yes, sir . . . Q. Do you --- what happened when one of those broke of A. Threads stripped off. . .
