I was also told that there was only one eye-witness. I took his name and came back to town -- to Dr. Wiley's office, where I found Mr. Johns. He was not dead. . . Q. Could you tell where Mr. Johns was when the car hit him? A. He was lying -- the blood was on his left side of the road, that is, highway No. 9, the paved road, just about where the road going toward Zoar turns off. He evidently had a package of stew beef in his hand, there was a piece of the beef hear the pool of blood, which indicated where he was lying, and another piece eleven steps this way down the road, lying about the center, which must have been about where he was hit, for the beef would have hardly blown back or rolled back that far. There was no signs much except where he had been lying . . . Q. Who was driving the car? A. They told me it was Fred Hinson -- we call him Doc Hinson. Q. Did he stop? A. Yea, and he and Dr. Wiley-- Dr. Wiley came along just after the accident -- brought Mr. Johns back to Mr. Wiley's office. Q. Did you talk to Mr. Wiley? Q. Yes. Q. What condition did you find him to be in, as to intoxication? A. I didn't seen any signs or smell anything on his breath, and I was pretty close to him. Q. (By HOUR) did you talk to Hinson? A. Yes. Q. Did he say anything about how it happened? A. Yes, he said he was meeting a car and just as he passed the car he saw the man in the middle of the road, practically. . .

I couldn't tell where I was going for a minute, but I pulled out and stopped, pullpulled over to the left side of the Chesterfield road and stopped, Kind of at an angle to the past in front of the filling station.
