Mr. J. H. Davis Engineer being duly sworn says . . . I ran a man and women [???] that track who attached my attention presently [illegible] & have near the he also attached my attention when he got out of the way. I direct my attention to the track . . . about 50 yds ahead of me I saw an object could not say what it was. It looked like a crow or bird on the track. I was running 3 over 35 miles an hor. I called on brakes twice before I stuck this object . . .I do not know whether he was black or white he has a sack looked like a flour sack on his back. He was standing still when I discovered him he then ran into the wood. . . . They did not find him. As soon as the engine was stopped I ran back to where the dead man lay. . . He was pretty dead when I got there. . .
