Thos P. Davis sworn says -- That this morning about day one of Mrs. Sarah Sweat sons came after him, and told him that his mother was in the yard dead. I went to Mrs. Sarah Sweat and found her in the yard dead. this was about sun up this morning . . .last December or January 1869 or 1870 deceased was at his house and started home after night deceased told witness a short time after that Stephen Talbert shot at her and came up to her (deceased) and jerked her about and told her that he would Kill her next time. Witness says deceased told him (witness) in the spring about cotton sowing time that Stephen Talbert met her on the road and hurt her and threatened to Kill her if he (Talbert) caught her out again after night. Witness says he asked deceased why she did not find Talbert over to keep the peace, and she (deceased) told witness that she was afraid Talbert would kill her if she leaved him. Deceased told witness several times that Stephen Talbert wanted her (deceased) to marry him ad she (deceased) refused to marry him (Talbert) and he (Talbert) told deceased that she should not marry any man that he (Talbert) would her kill, or shoot any man he saw talking with her (deceased).
Mrs. Ellen E. Kite Sworn Says, That the deceased is her Sister. Deceased told witness something in July or August last, that Stephens Tal buy had threatened to Kill her (deceased) if she left home with letting him know it.
M. A. Smith Sworn says. I was at Mrs. Sarah Sweat house about midnight on the 3d February 1871. The deceased seemed to be in good health then, never heard deceased complain of anything, except her leg, deceased said she had bruised her leg with an axe. Did not see any bruises on deceased face.
