I asked him how it occurred & he replied that Jimmie Hamilton had killed him I asked him how he Killed him. He said he stabbed him. I then asked him how the fight commenced & he told me that a few nights ago Wash Hamilton was passing my house & cursed me & abused me & my family & never saw him any more until this evening down at John Bushe's Mr Wash Hamilton came [?] the road coming west & I asked him did he have the same feeling & opinion of me & my family he had the other night or day & he said Wash Hamilton replied that he did. Mr Agner said he said you cant have any better time than now to settle it it said Wash Hamilton come on up the road to his Father's & stopped & called both his brothers ... Jim Hamilton said he had killed John Agner Junr[?] & was very sorry for it the contradiction occurred about the gun & about the use of rocks in the fight ... Jim Hamilton stood near & I asked him to help put the corpse in the wagon, he said certainly I will & did help us, & expressed sorrow as we put the corpse in the wagon. Mr Agner asked Mr Wash Hamilton was he in the same notion he was the other night. Wash said he did not Know that, that he was drunk he went on to say that he was sorry he was drunk
