Thomas Price= a small boy 7 years old being duly sworn deposes and says- ... he lay down on the floor beside the Chimney and went to sleep down at Uncle Johns house, was waked up by shooting from outside. Then there were 3 white men come in to the door. Uncle John was laying in bed and Aunt Louisa was laying outside the bed. When the shooting commenced they got up. They were white or yellow men not black. There was no light in the room, There was a fire outside the house The white men cut them from before, they fell right where they lie now, they staid a few minutes after they had cut Uncle John and Aunt Louisa There was some lightwood in the fire place, one of the men threw a piece of split wood afire on my pallet. I was in the corner. I picked it up and threw it into the fire place. I heard a cart or a wagon cross the bridge & go up the road. The man had large whiskers on. They had a fight with Uncle John & Aunt Louisa. I was frightened and after they went away I staid there and I went to sleep. I got up in the morning and was hungry. I saw blood on the floor and thought Uncle John was drunk. I went out to go to the quarters[?] and get something to eat I met Randall and went over to the quarters.

Lem Wheeler: being duly sworn deposes and says= that on Sunday morning he was at the quarters. He say Thomas came there and said that Uncle John had cut Aunt Louisa bad with an axe, and that they were both lying in the floor that he thought Uncle John was drunk- myself and Edmund Harrison and Julius Morgan came over called Aunt Louisa 5 times and got no answer. I went into the house and found them both dead. I took hold of Uncle Johns arm to wake up him and shook it when an axe that was in his hand slipped out. I said boys they are both dead let us leave them don't touch them at all. I thought they had been murdered, and that was why I thought we had better not touch anything.

has heard the evidence of Lem Wheeler and corroborates the same-except that in addition that he heard firing about 3 oclock in the morning

has known the deceased ever since last spring. That they have always lived happily together. Has never known a dispute between them. They were respected by black and white people, They have no enemies that he knows of, He never heard any threats against them. Don't know what he could have been killed for unless it was for his money ... I never knew John drunk nor Louisa neither. He had no liquor about the place that I know of.
