Mariah Nied[?] sworn says at request of witness decd went to Benja Barton and asked him to make his Bartons negro go out of the house Barton said no the Negro should stay the house was his. Bartons was dancing at the time and caught a stick out of a Small boys hand and struck decd on the side of the head witness saw Barton and Zack Williams whispering together after that Zack Williams cursed decd and said it was decd and Witnesses fault that the girls would not dance and he meant to whip them both and take possession of the house ... decd was sitting in the door cutting tobacco for Witness to smoke and Zack Williams made at decd with a Stick decd Jumped up and said he had Stood it as long as he could and made at Williams a man the name of James Jones threw[?] decd out of doors and when decd come round the house witness saw he was stabed and when he would draw his breath in it would go out of the hole that was cut in his back decd [?] considerable for fear days and Knights he decd had to be propped in bead he could not lie down
