T. A. Williams sworn, says: I know the deceased R. E. Luck. I saw him about dark yesterday evening Dec. 13. he was in rear of Mr. Gedde's store. I thought he was drinking. He seemed to be intoxicated. He staggered as he walked and had a bottle in his hand. I did not see him any more until I came in here. He was on foto when I saw him. could walk. Two or three negroes were with him. Do not know who they were. asked me to drink, suppose I saw him between 5 and 6 o'clock. T. A. Williams

D. B. Nesbitt sworn, says: I saw Dec'd in front of [?] Floyd's store last night about 8 o'clock. He was on horseback. Rode up street toward the Palmetto House. seemed to be drunk. was leaning forward in his saddle and swaying from one side ot the other. Had a shawl around him. was no one with him. rode a dark horse. Exxex Woodruff sworn says: I work at the Piedmost Hotel and live near this. I was coming up home this mornign just after day break and found a man lying on the side walk near Mr. David Thomas' house. was on his side in a crooked position. Looked at him and saw that he was not dead. did nto touch him. It was scarcely light enough to tell who a man was. I came on to Mr. Hill's and told them about the man. Then I came and told it at Mr. Gentry's. Mr. Gentry's son and driver and myself went back to him. He was still living. We tried to get him up but he could not stand or sit up. Was very wet and cold.
