Mrs. Cassie Cole sworns says: On last Saturday, 10th of April 1879 I was at home very near this place, about 11 o'clock, Lottee Smith came to my house and said that her sister, Sarah Smith, was sick, and that she wanted me to come up there. I came at once. When I came Sarah had given birth to a child. I asked her how long since it was born. She said about a minute. I washed the child and looked at it. It was a male child. I recognize this as the same child. Could see no signs of bruises or marks of violence about the child. When I cam Sarah was alone in the room. Mrs. Smith met me and said she did not know whether the child was born or not, that she had not been in the room since Lottee started for me. When I went to the bed, Sarah told me that the child was born. I could not see any sings of life in the child. I have never been called ot see any of the family under similar circumstances beofre. I am frequently called upon in such cases. The child was buried on Thursday evening in the garden. I thought the child about an eight month child. Mrs. Smith asked me where I should bury the child if in her place. I told her it was so small I should bury it in the garden. She replied if I said so she would do it. Cassie her mark Cole

Mrs. Mary Smith sworn, says: I have seen this child before. My daughter Sarah is the mother of it. It was born on last Thursday morning. My daughter is not married. She got up on Thursday morning as usual and helped to get breakfast. At breakfast I was told that she had gone back to bed. I did not know that the child was born until Mrs. Cole came and I went into the room with her. On last Wednesday, the day before the child was born, she dropped cotton seed all day. I did not expect any thing of the [?] to occur under a month or so. The child was dead when I saw it. About 4 o'clock Thursday evening we buried the child in the garden. The reason why I put it in the garden it was so far to the graveyard where my relatives were buried. I had no convenient way of getting it there. We did not make a mound over the grave as is usual. Mrs. and Mrs. Cole helped to bury it. Has never been a premature birth in the family before. I thought it might have been caused by hard work. I do not think that Sarah has ever done anything to try to destroy the child. Mary her mark Smith.

Dr. W. A. Harrison sworn says: I am a regular practicing physician in this county. I have examined this body carefully. I think from the length, weight, and dimensions of the head that the child is a matured, nine-months child. It is three inches over the average length. There are no marks of violence upon the body except that the bones of the head are separated from front to back, as if mashed. She child has lived. The lungs float, which is a true test, and from that the child has breathed and lived. From the amount of venus blood in the lungs I conclude that the child was smothered. If the child had been dead-born the lungs would have beena thin, black membrane and would sink immediately in water. W. A. Harrison, M.D.
