Friendly Gowdin being sworn testified that he had reason to believe that his wife Sarah was on terms of criminal intimacy with the deceased Eisex Brown, that in consequence of this belief on the night of the 11th Instant he watched his wife and the deceased Eisex Brown and caugth them in the act of cohabitation, that he then struck the deceased Eisex Brown twice upon the head with a stcik which he had previously procured from his house. Sarah Gowdin being swron testified that Eisex Brown came to her house early last night, that she went to church and that Eisex Brown afterwards returned home with her and that one the way he made a proposition to cohabit with her which she at first refused but after [?] upon his procuring to pay her twenty five dollars that she then met him behind the barn, that after they had got through her husband Friendly Gowdin came there and struck the deceased Eisex Brown twice with a stick, that the deceased did not speak after he was struck the first time, that deceased did not pay her the twenty five dollars stating that would do so when he was done.
