Doct. A. H. Bowen being sworn testified as follows. I found that the infant a male from its size and appearance believe it was at time and born alive the placenta was attached, looked as if some violence had been used about its neck. could not say positive in regard to finger or hand marking. from the cloth that was bound around its neck & head occipetal & left parietal bones [?]ed in. could not be positive about whether was caused by fall, blow or weight of dirt when hid in the ground. Polly Falks being sworn testified that the child in question was found about thirty yards from the house, that she went and examined, took it up out of the ground, found it in a bent position with a cloth bound rather tightly on its head and face. Believed that Peggy Badenbaught was the mother of the said child as she knew that the said Peggy was in a pregnant condition. She had denied that she was pregnant. Believes this from the fact that Peggy's children came into her yard on Friday last saying that their grandmother had told them to go away and that the window of Peggy's house was shut. Pompey White being sworn testified, Knew that Peggy Bedebaugh was pregnant, that yesterday Peggy told him that the child was his, that she had it in the fence corner and took it and buried it, that he asked her whether or not it was alive when it was born and she replied to him that she did not know, that as soon as it was born she covered it up and went to her house. Delia Brantley being sworn testified that her daughter Peggy Bedenbaugh always denied being pregnant, said her appearance was owing to cold, since the child was found that Peggy admits it was hers, says that it was born in the corner fo the fence back of her house, that it was born dead and as she did not know what dto do with it she took it and buried it not thinking it worth while to carry it to the house as it was dead, that Peggy did not admit that she was with mother of the child until yesterday about 10 oclcok A.M. after it was found, believes that the child in question was born on Thursday night last from the fact that Peggy left the house for a while and from the further fact that on Friday morning witness saw evidences of blood in Peggy's bed, that her suspicions were excited but Peggy explained this by saying that her menses had returned[?] upon her. Hannah Thompson being sworn testified that about on Friday evevning last she went to her house from the yard her daughter Polly told her Aunt Delia had sent her little boys off a fishing; I asked why did she sent them off and her reply was that she supposed Peggy had had a child.
