Tom, slave of C. Matheson called. Was standing by Mr. George Douglas' house steps with James Fraser, Nelson Pettifoot & Mr. Mendenhall's Jerry; Robert belonging to Mass Tom Shannon passed by first, and came back, said you were all a parcel of sons of bitches and had pushed up Wallie's Shannon to fight his son, and throwed a jug in the crowd. The jug hit Jerry. I did not see him throw the jug, but saw it in his hand when he passed by down the street. I saw the jug when it struck Jerry, who fell down. Bob then knocked me with his fist, picked up the jug and went up the street. Jerry was carried to the Mansion House, but I did not see by whom. Jerry kicked and seemed to be in much pain.

Nelson Pettifoot, free boy, called. Does not know what night of the week, or day of the month, at night, I come out of Mr. Sutherland's gate. I heard a fuss, the fuss was Mrs. S.A.C. Lee's, I went there to see what the fuss was about; when I got there I saw Tom Matheson, Wallis Shannon, Jim Lee and Jim Fraser. Jim Lee & Wallis Shannon were fighting; Mass William Lee came along down the street riding on horse, and hearing Jim Lee, told some one to hold his horse, when Wallis Shannon heard William Lee he run. I left the boys and was going down the treet. Mr. Mendenhall's Jerry and some of the boys hollowed to me "to hold on," they were going down too. Do not remember of seeing Jerry till he hollowed at me. All the bosy stopped under the tree at Mr. George Douglas' door, and I was asking them how the fuss commenced. Bob Shannon came along from up the street, and ordered Jim to go home and told him he would give him a hundred lashes as soon as he got home for poking with them loafers. He had a jug in his hand when he spoke. He passed on down the street and came back in four or five minutes. When he came back he found us boys there where he left us. Jerry was standing near the tree, and I was three or four feet from him. The rest of the boys were standing near when he came up. He said you boys were standing up to get his boy in antoher fray. We were not talking then. The moon was shining very bright at the time. I saw him take the jug with both hands and throwed it into the crowd. It came very near htting me. I saw it when it hit Jerry. Jerry fell right down and never spoke. He was near dead when young Dr. McCa? Came and threw water on him. He was taken up and carried to the Mansion House. I saw Bob afterwards pick up the jug and go up the street. He did not say any thing after he threw the jug. I did not see any white person except McKennedy who came up after the boy was knocked down.

Jim Fraser alias Jim West called. One Wednesday night, do not remember what month, I was in the Baptist Church up stairs when Wallis Shannon and Jim Lee got to fighting and hearing the racket in the street I came out. When I came out I saw Wallis & Jim Lee going up the street to fight. I went where they were, when I got there I saw Wallis Shannon and Jim Lee, nelson Pettifoot & Jerry belonging to Mr. Mendenhall. They were standing between Mr. Sutherland's and Mrs. Frank lee's. They were then fighting. Mass Willie Lee came down where they were and Wallis run. We all went on down the street then by Mr. Douglas's, while we were standing there Uncle Robert Shannon came and struck his son Jim Lee, and sent him home. Uncle Robert then went on down the street and was gone not more than ten or fifteen minutes. When he came back again he cursed us all and said we were the cause of that boy fighting his son; then he threw the jub in the drowd of us. I saw him when he threw the jug. After he did os he collared Tommy Matheson and gave him two or three licks with his fist on the head. I did not see the jug hit Jerry, but when I turned round Jerry was lying down, and the jug in the drain, as Bob went off he said Imeant to lay some of you d---d loafters. He had the jug in his hand as he went off; I saw him when he picked up the jug.
