Witness [?] C. Ballard sayeth that Mr. Ward & Mr. Hilliard had been fighting & in the engagement Mr. Hilliard bit Mr. Ward's ear & Mr. Ward hallowed and ... I went up to take Hilliard off. Not being able John Ballard came up & struck Hilliard with his fist & that Ward Ward Ballard & Hilliard were all intoxicated.

Witness [?] sayeth that after Mr. Ward had got up & said that his ear was bit that John Ballard came up as Mr. Hilliard was in the act of getting up & struck him with his fist & Mr. Hilliard reply'd to him ... that he would make him pay for it & also states from the circumstances that took place that it was not their intention to take his life & that Mr. Hilliard came to his death by the scuffle that took place with Mr. Ballard & Mr. Ward.
