on yesterday about 2 O-clock P.M. he saw Randal the negro and Sebourn Randolph (the overseer of Franis Bettis) running their horses through the field, that the overseer was on a horse and the negro on the mule which he usually Ploughed, that the mule threw the negro, and that he saw a piece of a fence rail in the negros hand before the mule threw him, that Randolph the overseer was persuing the negro, that the negro appeared to fall neather[?] on his head, that he fell in fresh ploughed ground, that Mr. Randolph lit[?] from his horse and took hold of the negro as he arose from the fall-the parties then continued in a scuffle until he ran about three hundred yards to them, then he found the negro down and Mr Randolph upon him, that he then took hold on the negro, and Mr Randolphs dog took hold on him, that Randolph struck the negro two or three times in the face with his fist, that Randolph then let the negro up, and asked Alfred Hughes to give the negro about a hundred lashes while he rested, that Alfred Hughes give the negro ninty six lashes mostly light except about fifteen lashes which were tolerably hard, but he does not think that the negros skin was cut, that the negro was not tied when Hughes whipped him, that then Randolph tied the negro and tied him to a tree and give him some more than a hundred lashes, Mr Hughes struck the negro with a small switch twice and then he saw Hughes whip him no more, that Mr Randolph then whipped him for some time, that the negro received about five hundred lashed from the two, and that he think that Hughes give him about one hundred or, not more than one hundred and ten of them, and that Mr Randolph give him the balance, that Hughes and Randolph then washed the negro in salt and water, that the negro throwd up freely about an hour after the whipping was over, that the negro was grunting very much before he threw up, and as soon as he vomited he left them, that the whiping was all done with a cow skin except the two lashes given by Hughes as above mentioned, that he did not think (after the whiping was over) that it was sufficient to indanger[?] the negros life, that the negro appeared to be well up to the time of the whiping, that the negro appeared to be impudent and did not humble himself to the last of the whiping, that after the negro had been washed in salt and water, he asked them to wash him again in the same, that the negro appeared to have some strange actions but at the time, he thought it to be [?].

Dr John J. Williams who opened the dead body and examined it. Was sworn and says. That the appearance of the external surface is, that the negro Randal has been severely whipped and bruised, the bruises extended to the depth of from half an inch to three quarters of an inch deep, and extend generally over the hold surface, the small intestines were found in a state of inflammation, ... the lungs were in a state of ingorgement

on a bill of indictment then and there to be prepared against Alfred L. Hughes and Sebourn Randolph for murder
