E. T. King being duly sworn say I was deputised by the Sherriff of Chesterfield County by the older of the Solicitor to arrest Boggan Cashs place got there abt day break . . . I got to Cash's Place and told them "if you find Boggan do not hurt Boggan if you can help it. U stationed the party around the house and lot . . . while I was placing guard Mr Jackson stated to me some one came to the front door of the barn. I came back to Mr Avery and Mr. Helton and told them there was some person in the barn loft. I then went back to men Jackson and a black man passed through front fate of the lot and when he got to the step I heard some person speak to him. The black man. Jackson remarked "I think that is W. B. Cash's [??ice]" I told Mr. Jackson to go and tell the guard I had placed around the house to come to the barn. . . . Before the firing commenced at lot I heard some one say halt. Shortly after this I heard gun fire. I recognized the voice that said salt as Mr Hilton. Directly after firing commenced at lot it commenced at house. I then came around to where Mr Hilton and Mr Avery was I found Mr W. B. Cash laying where he is now laying with two guns laying by him. . .
